Family law FAQ

What are the different types of divorce?

Explore your options

In a contested divorce, certain factors may not be resolved amicably by the couple due to differences of opinion, such as child custody or the division of property.

It is also possible to obtain a divorce by filing a joint application, more commonly known as an amicable divorce, and preparing a draft agreement that settles the consequences of the separation. This way of proceeding is more practical in terms of cost and duration, thanks to the agreement of both parties. There are no exceptional factors that prevent this process and the parties can resort to mediation in order to find an agreement that is favourable to all.

We can help you file an application for an amicable divorce or help you draft the application to bring your divorce action, if it is contested

What are the grounds for divorce in Quebec?

Explore your options

In Quebec, there are three valid reasons:

1. The spouses have been living separately for at least one year prior to the pronouncement of the decision on the divorce action and were living separately at the date of the institution of the proceedings

2. Adultery (only applicable to the deceived spouse)

3. Physical or mental abuse

If you do not have one of the grounds listed, it is always possible to proceed by way of legal separation in order to file an agreement with the Court settling the consequences of the separation.

Why file for divorce with a lawyer?

Explore your options

Several procedures, forms and legal mentions are essential in order for a judge to accept your file and pronounce the divorce. Thus, in order to avoid additional delays caused by a refusal of the Court for non-conformity, a procedure via a lawyer would allow you to avoid many procedural hassles;

What does Neolegal do for a joint divorce? Neolegal will provide you with a telephone consultation, as well as the documentation you'll need to make the call. We'll then draft all the procedures you'll need to file for divorce. You'll be able to submit everything to the court yourself, as we'll provide you with a document explaining the next steps.

Can I file for divorce alone?

Explore your options

Yes, it is possible to do this on your own with the appropriate court procedures which our team can assist you with. We also offer uncontested divorce proceedings which you can initiate on your own and submit to your ex-spouse, or if there is agreement on all elements of your divorce, via a joint amicable divorce.

Can we ask for a divorce, even if we have gone to mediation?

Explore your options

Mediation does not allow you to obtain a divorce unless your final agreement was homologated (made official) by the judge and a judgment was rendered. We therefore suggest that you formalise by filing for a joint divorce.

What happens after we file our legal documents?

Explore your options

Once everything has been filed with the Court, the Court will analyse your file and check that all the documents are signed and that the forms are included in the proceedings, so that the divorce is undertaken in a free and informed manner by the parties. You will receive the divorce decree by mail.
